In the Matter of a Proceeding for the Improvement                               ORDER CALLING PUBLIC
of Chestnut Road Water District, in the Town of Pomfret,                     HEARING TO BE HELD
Chautauqua County,                                                                                     September 9, 2026, at 5:45 p.m.        
Pursuant to Section 202-b of the Town Law                                                                               
                WHEREAS, the Town Board of the Town of Pomfret, in the County of Chautauqua, New York, on behalf of the Chestnut Road Water District in said Town, has requested CPL Engineers, duly licensed in the State of New York, to prepare a Map Plan and Report for the increase and improvement of facilities of the District, consisting of the replacement of approximately 3,300 linear feet of existing water main, with a new 8 inch main, gate valves, hydrants, meter pits and meters, and other appurtenances necessary thereto, and including land or rights in land, for equipment, machinery and apparatus required therefor; and pursuant to the direction of the Town, the Engineers have completed and filed with the Town Board such Map Plan and Report for said increase and improvement of facilities of the District dated June 2026, and have estimated the maximum cost thereof to be expended at $960,000.00;

WHEREAS, the Chestnut Road Water District has previously been established by the Town Board as an ad valorem District in said Town, and

WHEREAS, said District is operational in providing water service through water mains currently, and

WHEREAS, the Town Board has been advised that certain funding grants may be available for which the Town will apply, but as there can be no assurance of same, that the cost of the improvements will be bonded in an amount not to exceed $960,000, and that the expenses thereof shall be assessed, levied, and collected on an ad valorem basis from the several lots and parcels of land within said Chestnut Road Water District.

NOW THEREFORE, be it

ORDERED, that a Public Hearing at a meeting of the Town Board of the Town of Pomfret be held at the Town Hall, 9 Day Street, Fredonia, New York on the 12th day of August at 6:15 p.m. to consider said increase in improvement of facilities of the District, and to hear all persons interested in the subject thereof concerning the same, and for such other action on part of the Town Board with relation thereto as may be required by law; and it is further

ORDERED, that the Town Board will consider all matters relating to the State Environmental Quality Review Act (SEQR), and it is further

ORDERED, that the Town Clerk  is hereby directed to post and publish of this Public Hearing as required by law.

FNOTICE OF PUBLIC HEARING

SOLAR GENERATION PLANT APPLICATION


            PLEASE TAKE NOTICE that the Town Board of the Town or Pomfret will hold a Public Hearing on September 9, 2026 at 6:15 pm at the Town Hall, 9 Day Street, Fredonia New York, to review the application of Pomfret IV PV, LLC for a proposed solar generation facility with a name plate capacity of 750 kW AC, to be located on property owned by Civiletto Revocable Trust at 4579 VanBuren Rd, Town of Pomfret.  The property is also known as tax map SBL 112.00-3-4.

            The applicant seeks a special use permit under the Solar Facilities Regulation Law of the Town of Pomfret.  They also seek variances to certain requirements therein, including a set-back waiver from Two Hundred, Fifty (250) feet to Thirty (30) feet. Connection to National Grid on VanBuren Rd.

            A complete copy of the application is on file in the Office of the Town Clerk and available for public inspection during business hours.

            Please take further notice that the Town Board will consider all matters relating to SEQR at the hearing.

            All interested parties will be heard, and may submit written comments to the Town Board in advance of the public hearing.

NOTICE IS HEREBY GIVEN that Public Hearing #4-26 will be held by the Pomfret Planning Board on September 14, 2026, at 6:30 PM at the Pomfret Town Hall, 9 Day Street, Fredonia, NY 14063 to consider the appeal of Loren Smith for a Minor Subdivision of property located at 8190 Route 60, Cassadaga, NY 14718. This property is described on the tax map as SBL: 182.00-1-18 and is currently zoned Mixed-Use Corridor (MUC) under the Town of Pomfret Zoning Code.

The proposed action is to divide two (2) lots within the 10.30+/- acres of land. The first lot: 1.64 acres, the second: 8.67 acres.

This Minor Subdivision application is open to inspection at the Town of Pomfret Planning & Zoning Office, 9 Day Street, Fredonia, NY 14063.   

PLEASE TAKE FURTHER NOTICE that the environmental significance of the proposed request under SEQRA will be reviewed by the Board at said hearing.
